About the national freezing funds register

In accordance with the provisions of the Ordinance no. 2020-1342 of 4 November 2020 strengthening measures to freeze assets and prohibit making an economic resource available, whether decided by the United Nations, the European Union, or the national authorities, asset freezing measures are applicable by natural and legal persons.

To provide access to the list of persons and entities subject to sanctions, the Department of Budget and Treasury publishes and updates the national asset freezing register. This register contains the details of all persons, entities, and vessels concerned by asset freezing measures in force within the territory of France.

Terms of Use

The purpose of these Terms of Use is to set out the procedures for using and browsing this website, known as “Freezing funds and economic resources in the Principality of Monaco”.

1. DEFINITIONS

The following words and phrases, beginning with a capital letter, whether used in the singular or plural, are employed herein with the meanings specified below:

  • Terms of Use” or “Terms”: these Terms and Conditions of Use.
  • Personal Data” means any information relating to an identified or identifiable individual (“person concerned”). An “identifiable individual” is considered to be any individual who may be identified, directly or indirectly, including through reference to an identifying detail such as a name, an identification number, location data, an online username, or one or more attributes specific to his or her physical, physiological, genetic, psychological, economic, cultural or social identity;
  • Website”: means the information system used to consult, download to obliged entities and notably those specified by      Article 3 of Sovereign Ordinance no. 8.664 of 26 May 2021 pertaining to the procedures for freezing funds and economic resources in accordance with international economic sanctions, the national list of natural and legal persons, entities or organisations, subject to measures to freezing funds and economic resources in accordance with Sovereign Ordinance no. 8.664 of 26 May 2021 pertaining to the procedures for freezing funds and economic resources in accordance with international economic sanctions (hereinafter referred to as “National List”), published by the Department of Budget and Treasury and available at the following address: geldefonds.gouv.mc ;
  • User”: means anyone accessing the Freezing funds and economic resources Website

2. PURPOSE OF THE WEBSITE

The purpose of these Terms of Use is to set out the terms and conditions for the issue and use of the Website, allowing users to consult the National List of natural and legal persons, entities or organisations, subject to measures to freezing funds and economic resources in accordance with Sovereign Ordinance no. 8.664 of 26 May 2021 pertaining to the procedures for freezing funds and economic resources in accordance with international economic sanctions 

The Website allows users to:

  • Consult the National List 
  • Download the National List, Ministerial Decisions and their annexes 
  • Subscribe to the newsletter containing details of updates to the National List and news about the freezing funds and economic resources 
  • Access the Website API in order to download the National List in JSON, XML, PDF, or XLS format.

3. ACCESS TO THE WEBSITE

The credentials used to access the Website are strictly personal and confidential. 

With the exception of any connection costs applicable, access to the Website is free of charge. Any connection costs are borne by the User and will not be refunded by the Government.
When using the Website, the User may subscribe to the National List Newsletter. In this case, you will be invited to enter your email address. 

The User may contact the Government using the contact form and must enter your Surname, first name, email address, and the content of your message.

The User undertakes to enter your data under your own liability, control, and direction, and undertake to ensure that the data you provide are accurate, complete, and up to date. You also undertake not to commit identity theft. 

The User must supply a valid email address when subscribing to the Newsletter. 
This address is required as it will be used to confirm your subscription to the Newsletter, and to send you news and updates to the National List of freezing funds and economic resources.

The User who wish to inform the Government of a mistake or correction are asked to send an email to the following address: dbt.geldefonds@gouv.mc or by phone: (+377) 98 98 87 72

In the event that access to the Services is interrupted or unavailable, User may contact the relevant Government agency for more information. 

4. DATA RETENTION 

The Website has an automated process to permanently delete all personal data relating to the User, three (3) months after the data has been entered on the freezing funds website of the Department of Budget and Treasury. 

5. COMMITMENT RELATING TO USE OF THE ONLINE SERVICE AND ASSOCIATED CONTENT

Use of the Website is optional.

The user undertakes not to commit, on this Online Service, any unlawful act or fraudulent act of any kind.

These terms of use prohibit any act which could tarnish the name and/or the image of the State of Monaco, or damage, overload, disable, discredit or compromise the Website.

In particular, the following are prohibited: the transmission by email or any other means of content whose purpose is to persecute, harass, defame, discriminate or abuse; or any other dissemination of information or opinion of a personal nature relating to one or more individuals, or infringing human rights or the rights of Users who are minors.

Correspondence must be courteous in nature at all times and comply with the basic rules of politeness.

6. WEBSITE SECURITY 

The Website requires a sufficiently fast internet connection and equipment and resources enabling to access and browse on the Website. The browser must be configured to allow session cookies.

The User is aware of the risks associated with using the internet and accepts the corresponding limitations and risks.

The Government makes every effort to secure the Website with regard to the risks involved and the nature of the data which is processed. 

The User is prohibited from fraudulently accessing or continuing to visit all or part of the Website, deleting or changing the information included on the Website, fraudulently adding information, altering the Website, or interfering with its proper functioning.

The User shall not attempt to make changes to or manipulate the pages of the Website in such a way as to conceal, hijack or modify the latter. 

It is strictly prohibited for Users to: (i) modify and alter the Website and/or its contents; (ii) access or seek to access the Website’s source code using decompilation, reverse engineering or any other technique or method; (iii) make accessible or send parts of the Website or content to which access is restricted to third parties; (iv) use the Website for an unlawful purpose, to which end the User undertakes not to include any false, incomplete or inaccurate information, or any virus, Trojan horse, worm, time bomb or any other program designed to damage, produce a harmful effect, intercept or block any system, data or personal information. 

Where necessary, the User must have a secure connection or network and an up-to-date operating system to protect, in order to prevent, as far as possible, the Government from any damage relating to insecure use of the Website. 

The User shall take all appropriate measures to protect their data and equipment, and they are responsible for the security of their data and network, which they use at their own risk.

In the event that the User is aware of an event that could damage the security of the Website, such as an error, fault, malfunction, hacking, loss of data, vulnerability or irregularities, they are invited to get in touch with the Government immediately by emailing: dbt.geldefonds@gouv.mc

7. INTELLECTUAL PROPERTY

These Terms of Use do not grant or assign to the User any intellectual property rights whatsoever.

7.1 Copyright 

Certain rights associated with content published on this Website belong exclusively to the Government, except where it is explicitly indicated that the rights belong to a third party. This includes, but is not limited to, all texts, comments, titles, names, photographs, sounds, images, data, drawings, animated sequences with or without sound, videos, functionality and charts, which are protected by the legislation on copyright protection in force in Monaco.
Any use, representation, transformation, reproduction, adaptation or dissemination, in whole or in part, of any element belonging to the Government on any media and via any procedure is prohibited, unless expressly authorised by the Government, and constitutes a criminal offence punishable by the Courts of Monaco

7.2 Trademarks

Trademarks and/or logos belonging to the Government and appearing on the Website are protected trademarks under the legislation that applies in Monaco. Any reproduction of these trademarks and/or logos, in whole or in part, without the permission of the Government, is a criminal offence punishable by the Monaco courts.

8. LIABILITY

The Website must not be used in an abusive or malicious way. The Government cannot be held liable to the User for direct or indirect damage of any kind resulting from the use or unavailability of the Website.

Generally speaking, the User undertakes to use the Website: 

  • In compliance with the laws and regulations of Monaco, the rights of third parties, and intellectual property rights
  • Fairly and in accordance with their intended purpose
  • At their own risk

The User acknowledges and accept that, the Government may not be held liable for the Website, notably in the event of hacking, alteration or misuse of data, or any unlawful use or use which causes prejudice to the User or a third party.

The Government shall endeavour to ensure that the information published on this Website remains accurate and up to date, but accepts no responsibility for the provision or use of incorrect or obsolete information. Consequently, the Government may not be held liable to compensate any direct or indirect damage.

The Government does not guarantee the continuity, accessibility or availability of the Website or related services.

The User of the Website is required to comply with these Terms of use and are prohibited from using or attempting to use the Website and its functions for any purpose other than those provided for under these terms of use.

9. PROTECTION OF PERSONAL DATA

In accordance with the applicable provisions on protecting personal data in the Principality of Monaco, the information gathered via the the Website is collected by the State of Monaco/ Department of Budget and Treasury, acting in its capacity as the data controller.

As part of the operation of this Website, the Government processes personal data for the purpose of “Management of a website allowing the publication of the National List of natural and legal persons, entities or organisations, subject to measures to freezing funds and economic resources

This processing with the Department of Budget and Treasury is part of the remit of the Government (Department of Budget and Treasury)
It is justified by:

  • Pursuit of a legitimate interest on the part of the Government to simplify administrative procedures for citizens with the Government, in accordance with Sovereign Ordinance no. 3.413 of 29 August 2011 concerning various measures pertaining to the relationship between the Government and its subjects and to enable the Government to satisfy its obligations and to carry out its appointed tasks, in accordance with Sovereign Ordinance no. 8.664 of 26 May 2021 pertaining to the procedures for freezing funds and economic resources in accordance with international economic sanctions

Information processed as part of the processing is for the Government (Department of Budget and Treasury) and is never used for commercial or advertising communications. 

Some information requested on the Website is mandatory (e.g. surnames, first names, or email address). If the information marked as mandatory on the data collection forms (those fields marked with an *) is not provided, the User may not receive the Newsletters from the Department of Budget and Treasury, or submit the contact form.

In accordance with the applicable legislation in the Principality, the User has the right to access and rectify their personal data, and the right to object to the processing of their personal data.

11. COMPETENT JURISDICTION

These Terms of use are governed by the laws of Monaco.

In the event of a dispute as to the interpretation, validity, or performance of the Terms of Use, and where no amicable agreement can be reached, the competent courts of the Principality of Monaco shall have exclusive jurisdiction with the express consent of the User, notwithstanding cases involving multiple respondents.
